Amazon Section 3 deactivation: what it means and what to do
The short answer. "Section 3" is the Term and Termination section of Amazon's Business Solutions Agreement. When your notice says your account was deactivated "in accordance with Section 3," Amazon is telling you it used its contractual right to suspend or terminate an account, sometimes immediately. It is not one single reason. It is a door that several different problems can walk through. And contrary to what you may have read online, the agreement does not say a Section 3 case can never be appealed.
If you have just read that notice, take a breath. It sounds like a verdict. It is closer to a heading. What matters is what is underneath it.
What does "deactivated in accordance with Section 3" actually mean?
Section 3 of the US Business Solutions Agreement lists five grounds on which Amazon can suspend or terminate an account immediately. In plain English:
- A material breach that was not cured within 7 days of a cure notice.
- The account has been, or may be, used for deceptive, fraudulent or illegal activity.
- Your use of the services has harmed, or might harm, other sellers, customers or Amazon's legitimate interests.
- Your Account Health Rating is below the deactivation threshold.
- Amazon is required to do it by law.
So the phrase on your notice tells you Amazon used the contract. It does not tell you which of those doors it used. That is the part we work out. Notice how wide that is. A metrics problem and a suspected fraud case can arrive wearing the same three words.
Why are Section 3 notices so vague?
Amazon's agreement says it will promptly tell you the reason and any options to appeal, except where it believes that information would hinder an investigation or help someone get around its safeguards. In plain terms, Amazon can say less when it thinks saying more would help the wrong person. That is why some notices read like a form letter and some do not mention an appeal path at all.
My honest read: when the notice is thin, the thin part is a clue, not a dead end. It tells you the real work is figuring out what Amazon saw.
Can a Section 3 deactivation be reversed?
Sometimes, yes. A common wrong answer online is that Section 3 can never be appealed. The agreement does not say that. What is true is that these cases are serious and usually need a precise, evidence-based response. They are not the place for a template, a guess or a rush.
I cannot tell you from outside whether yours can be reactivated, and I would be wary of anyone who says they can. It depends on which ground Amazon relied on, what is true in the business, and what can be shown with real documents. If your notice calls the decision final, read permanently deactivated.
Why is it not one single reason?
Because the five grounds cover very different situations. In practice, the families we see behind Section 3 notices are:
- Account Health Rating below the line. Ground four is literal: it refers to the Account Health Rating threshold. See Account Health Rating.
- Authenticity and complaints. See inauthentic complaints and IP complaints.
- Related accounts. See related accounts.
- Review, verification or sourcing questions. See under review and verification.
- Harm to customers or deceptive practices. The broad grounds two and three.
Two sellers with the same words on the notice can need completely different cases. That is the main reason copied advice fails here.
What should I do first?
One quiet step: save a complete copy of the notice and everything around it, including dates and any earlier warnings. Then pause. Do not resubmit in a hurry, and do not open a new account to keep selling. Amazon says opening a new account to avoid dealing with violations leads to automatic deactivation of related accounts.
That is the whole of my ask today. After that, the work is to read the notice against the history, and that is a job for a Case Autopsy.
Can I reactivate a Section 3 account myself?
You can try, and Amazon's own guidance expects a seller to find the root causes, say what was done and when, and support it with evidence. The trouble is that Section 3 gives you the least information of any notice, so the root cause is the hardest part to find alone. This is also the stage where a wrong first guess follows the case into every later reply. If you have been rejected, see appeal denied.
When is help worth it?
When the notice is vague, when you have been rejected, when funds or inventory are held, when the case touches fraud, authenticity, IP or related accounts, or when another service already tried. Section 3 cases are part of the Hard Case Desk's core work.
What about my money?
A Section 3 deactivation often comes with held funds. Amazon's published funds policy treats that separately from the account appeal. Read funds held.
Frequently asked questions
What does "your seller account has been deactivated in accordance with Section 3" mean?
Amazon used its contractual right to suspend or terminate an account. The notice does not always say which of the five grounds applied, so the next step is to find out.
What is the Section 3 violation?
There is no single "Section 3 violation." Section 3 is the clause. The violations behind it vary: unresolved breaches, deceptive or illegal activity, harm to others, an Account Health Rating below threshold, or a legal requirement.
Can you appeal a Section 3 deactivation?
Yes, in many cases. The agreement says Amazon will tell you the reason and any options to appeal, except where it believes that would hinder an investigation. Check your notice for an appeal path, but do not assume the case is closed because the notice is short.
Can a Section 3 account be reactivated?
Sometimes. It depends on the ground, the facts and the evidence. No one can promise it.
Is there a Section 3 appeal template?
Not one worth using. Templates cannot hold your facts, and a Section 3 case is decided on facts. Market Wize works Zero Template.
Who handles Section 3 cases?
Specialist appeals services, including the Hard Case Desk at Market Wize. We start with a free case check and a Case Autopsy of everything Amazon sent and everything already submitted.
Will Amazon hold my money after a Section 3 deactivation?
It may. Amazon's Funds Disbursement Eligibility Policy says funds are in general withheld for 90 days where there are risks, and that the period may be extended if a risk persists. See funds held.
Does Section 3 mean I can never sell again?
Not necessarily. Read the notice for words like "final." If it does not say that, there is often still a path to explore.
